Terms of Service

Draft template — not yet reviewed by a lawyer. This text describes how the software behaves so that an operator has an accurate starting point. Replace the bracketed items and have counsel review it for your jurisdiction before offering the service to the public.

Last updated: [DATE]. Operated by [LEGAL ENTITY NAME], [ADDRESS] ("we", "the registry").

1. What the service does

Synth ID lets you register images, music and video, creates a copy you can share (watermarked, for images), looks for copies on the public web, and helps you offer licenses or request removal. Registration records what an account registered and when. It is a provenance record. It is not a legal determination that you own the copyright.

2. Your account

You must give an email address you control and keep your password secret. You are responsible for what is done through your account. You can delete your account at any time from Settings; this removes the assets you registered and their files.

3. What you may register

Register only works you created or are authorized to manage. Do not register works to claim rights you do not hold, or material that is unlawful to possess or distribute. We may remove registrations and close accounts that break these terms.

4. Notices you send to other people

Notices and license offers are sent on your behalf and in your name. You are responsible for their accuracy. A formal takedown notice contains statements you make under penalty of perjury; knowingly misrepresenting that material is infringing can make you liable for damages. We limit how many notices an account can send and require a verified email address to send them. Recipients can dispute a notice, and you agree to review disputes in good faith.

5. Detection is not certainty

Matches are produced by automated comparison and can be wrong. A match is evidence that a file may derive from a registered asset, not proof of infringement. A use you report yourself is recorded on your word and is not verified by the service. The service cannot find every copy, and cannot alter or remove copies that are not loaded through Synth ID.

6. Licenses and payments

A license is an agreement between the registrant and the licensee on the terms shown on the offer page. We are not a party to it. Payments are processed by [PAYMENT PROCESSOR]. [REFUND POLICY.] [FEES, IF ANY.]

If you set a work to "AI training permitted with a paid license", you offer it, with the labels you wrote, to AI services integrated with the registry at the per-work price you set. A training license is bought for many works at once; your share is the price of your works in it. Works showing identifiable people are offered only if you state that you hold their consent, and you are responsible for that statement. [HOW AND WHEN REGISTRANTS ARE PAID, MINIMUM PAYOUT, AND THE CONTRIBUTOR AGREEMENT — to be drafted by counsel.]

7. Content you upload

You keep all rights in your works. You give us permission to store them, create the protected copy, compute fingerprints, serve the controlled URL, and submit the protected copy to reverse-image search providers you enable, solely to operate the service for you. A "no AI training" setting is published as a declaration in the provenance record, in delivery headers and in embedded metadata; we cannot technically prevent a third party from ignoring it.

8. Availability and liability

[SERVICE LEVEL, WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY — to be drafted by counsel for the governing jurisdiction.]

9. Copyright notices and designated agent

Notices of claimed infringement concerning material on this registry go to the designated agent below (set by the operator). Registrants can download a takedown package for any work from its asset page.
